Training session on the evaluation of anti-competitive agreements and practices of abuse of a dominant position

On Friday, October 10, 2025, at the National Institute of Justice, the training session with the generic "Theoretical and practical aspects regarding the evaluation conditions of an anti-competitive agreement, respectively of a practice of abuse of a dominant position" was held.

The opening of the event was marked by the interventions of the director of the National Institute of Justice, Ramona Strugariu, the president of the Competition Council of the Republic of Moldova, Alexei Gherțescu, and the Twinning resident advisor, Cristina Butacu.

The training activity, intended for judges, prosecutors and representatives of the Competition Council, was supported by Ionel Florea, judge at the Administrative and Fiscal Litigation Section of the Romanian High Court of Cassation and Justice, and Cătălina Pântea, deputy director of the Legal Assistance and Litigation Department of the Romanian Competition Council.

During the training, the experts addressed relevant aspects of European jurisprudence regarding the application of Articles 101 and 102 of the Treaty on the Functioning of the European Union (TFEU), presenting general principles of interpretation and representative cases tried by Romanian courts, as well as the relevant findings established by the Constitutional Court. Also, both the situations related to the enterprises that facilitate the realization of anti-competitive practices, as well as the essential elements in identifying and sanctioning the abuse of a dominant position, were analyzed.

The event was organized within the Twinning Project "Strengthening the institutional capacity of the Competition Council for the application of policy in the field of competition and state aid, in accordance with the best practices of the EU", financed by the European Union and implemented in partnership with the competition authorities of Romania, Lithuania and Poland.
