New book title in the INJ Library

The library of the National Institute of Justice was completed with a new title - the monograph "Respect of human rights in criminal prosecution - National criminal procedural regulations, European and international standards", elaborated by Dinu Ostavciuc and Tudor Osoianu.

The work includes seven chapters that address the following aspects: fundamental human rights and freedoms and criminal procedural law; the positive obligations resulting from the protection of the right to life and the inadmissibility of torture; guaranteeing the right to freedom and safety during the criminal investigation phase; the specifics of the procedural guarantees resulting from the right to a fair trial at the criminal prosecution stage; guaranteeing the right to private life during the criminal investigation; protection of property rights in criminal proceedings; respecting the law non bis in idem and the security of legal relations in criminal prosecution. The monograph ends with general conclusions and recommendations by law ferenda aimed at correcting the malfunctions found.

The topicality of the topic addressed is highlighted by the urgency of harmonizing national legislation with the standards of the European Convention on Human Rights and with the jurisprudence of the European Court of Human Rights. This necessity becomes even more visible in the context of the candidacy of the Republic of Moldova to the European Union, when such demands have turned from theoretical desires into imperative conditions of the institutional and democratic process.

The monograph identifies the legal realities in which the inadequacy of internal regulations or deficient judicial practices generate systemic risks of violation of procedural rights, at the same time providing normative benchmarks and proposed solutions.
