Round table on the optimization of the amicable dispute resolution process
The National Institute of Justice and the Mediation Council, with the support of USAID Moldova, organized, today, October 25, 2024, a round table with the generic theme "Improving the mechanisms for confirming and executing transactions through which the parties agree on the amicable settlement of the dispute".
The event brought together judges, mediators, as well as representatives of the Ministry of Justice and the Mediation Council, facilitating a constructive dialogue regarding the optimization of both the procedure for confirming transactions concluded in order to prevent civil litigation, as well as the procedure for issuing enforceable titles.
The round table, moderated by Felicia Chifa, doctor of law, university lecturer, mediator, began with greetings from the interim Director of the National Institute of Justice, Adrian Cerbu, the head of the Directorate of Professions and Legal Services at the Ministry of Justice, Angela Maxim, and the President of the Mediation Council, Marcel Burlacu.
In his speech, the interim Director of the National Institute of Justice, Adrian Cerbu, noted the importance of the interaction between judges and mediators, two professions that, although distinct, are complementary within a modern legal system, efficient and centered on the needs of litigants.
At the round table, issues regarding the institution of mediation and transactions concluded with the participation of the mediator were addressed. In particular, the legal limits of the agreements and the current challenges regarding their confirmation by the courts were analyzed. During the discussions, some conclusions and recommendations for improving the procedural framework were outlined.
